DMCA & Copyright Policy

SWC AI LLC ("Hubbby") respects the intellectual property rights of others and expects its users to do the same. We respond to clear notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

Substantially all visual content on Hubbby is generated by artificial intelligence and does not reproduce any pre-existing work. See our 2257 statement. Where a user submission does infringe, the procedure below applies.

1. Submitting a Notice of Infringement

If You are an intellectual property owner or an agent thereof and believe that either (1) any Content or User Submissions on the Service or (2) any material or activity contained on an online location to which Hubbby has referred or linked users, infringes upon Your intellectual property rights, You may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing (see 17 U.S.C. 512(c)(3) and 512(d) for further detail):

  1. a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on the Service are covered by a single notification, a representative list of such works on the Service;
  3. identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (or in the case of referrals or links that are claimed to lead to infringing material or activity, identification of the reference or link that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate that reference or link);
  4. information reasonably sufficient to permit us to contact You, such as an address, telephone number, and, if available, an email address;
  5. a statement that You have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. a statement that the information in the notification is accurate, and under penalty of perjury, that You are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

You acknowledge that if You fail to comply with all of the requirements of this section, Your DMCA notice may not be valid. Emails or notices sent to Hubbby without a proper subject line, or for purposes other than communication about intellectual property claims, may not be acknowledged or responded to.

2. Designated Copyright Agent

3. Our Response Timeframe

We acknowledge receipt of a complete notice within 2 business days and act on valid notices — by removing or disabling access to the material — within 7 business days of receipt. Notices alleging content that depicts a minor, or that depicts an identifiable real person without their consent, are treated as urgent and actioned on receipt rather than within the timeframe above.

4. Counter-Notification

If You believe material of Yours was removed or disabled by mistake or misidentification, You may send a counter-notification to the Copyright Agent above containing:

  1. Your physical or electronic signature;
  2. identification of the material that has been removed or to which access has been disabled, and the location at which it appeared before it was removed or disabled;
  3. a statement under penalty of perjury that You have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and
  4. Your name, address and telephone number, and a statement that You consent to the jurisdiction of the Federal District Court for the judicial district in which Your address is located (or, if Your address is outside the United States, the District of Delaware), and that You will accept service of process from the person who provided the original notification.

On receipt of a valid counter-notification we will forward it to the original complainant. Unless they notify us that they have filed an action seeking a court order to restrain the allegedly infringing activity, we may restore the removed material in 10 to 14 business days.

5. Repeat Infringers

In accordance with the DMCA and other applicable law, Hubbby has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also limit access to the Service or terminate the account of any user who infringes the intellectual property rights of others, whether or not there is repeat infringement. See Section 3 of our Terms of Use.

6. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.
