This Content Provider Agreement (the "Agreement") applies to every user who uploads, creates, generates, or otherwise makes content available through Hubbby (Hubbby.ai, operated by SWC AI LLC), including real-time or live content (each, a "Content Provider"). By submitting or generating any content on the Service, you agree to be bound by this Agreement in addition to our Terms of Use and Community Guidelines.
Hubbby's imagery is predominantly generated by Artificial Intelligence and does not depict real people (see our 2257 Statement). Where any content does depict a real person, the requirements below apply in full.
As a Content Provider, you must not engage in or facilitate any activity that is illegal or that otherwise violates our Terms of Use, Community Guidelines, or applicable law (the "Standards"). Prohibited content includes, without limitation, any content involving minors, non-consensual acts, or any other category prohibited by the Standards.
Absolute prohibition: minors and child sexual abuse material.
You must not publish, generate, or distribute any content that depicts, describes, or sexualizes a person under 18 years of age. This applies in full to fictional, illustrated and AI-generated content: that no real person exists is not a defence. It includes characters who are childlike in appearance or behaviour, characters canonically under 18 regardless of any stated age, and any character card, description, scenario or prompt intended to produce such content.
Violation terminates this Agreement immediately, forfeits any unpaid balance, and is reported to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement. See Section 4.1 of the Terms of Use.
For any content that depicts a real person, you must obtain and keep on record written consent from every person depicted, specific to each of the following:
For any content that depicts a real person, you must verify the identity and age of every person depicted to ensure that all such persons are adults (18 years of age or older), and you must be able to provide supporting documentation to Hubbby upon request.
You must retain the consents and verification records described above and provide them to Hubbby promptly upon request. Failure to maintain or produce these records, or any breach of this Agreement, may result in removal of content, suspension, or termination of your account, and referral to law enforcement where required by law.
Where Hubbby requires it, the written consent referenced above must be documented using a model release form acceptable to Hubbby. A draft model release form and instructions for submitting completed releases are available on request from support@hubbby.ai.
